Terms and Conditions

Last updated: November 8, 2026

Welcome to truckingcapital.com (the “Site”), owned and operated by Freight Factoring Specialists LLC (“FFS,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including any content, tools, calculators, forms, live chat, and materials available on it. By accessing or using the Site, submitting an inquiry, or requesting a quote, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Business Use Only

FFS provides commercial financial services to trucking businesses, not to individual consumers. The Site and the services described on it, including freight invoice factoring, fuel advances, and our fuel card program, are intended solely for motor carriers, owner-operators, and other businesses acting for commercial purposes, and not for personal, family, or household use. By using this Site or submitting any information to us, you represent that you are at least 18 years old, are authorized to act on behalf of the business you represent, and are seeking our services for a legitimate business purpose.

2. The Site Is Informational

The content on this Site, including descriptions of our services, funding timelines, sample rates and fees, illustrations, and the quote calculator, is provided for general informational purposes only. Nothing on the Site constitutes:

  • A commitment, offer, or guarantee of funding, an advance rate, a fee, or any specific terms;
  • An approval or credit decision of any kind; or
  • Financial, legal, tax, or accounting advice.

Figures shown by the quote calculator are illustrative estimates based on the invoice amount you enter and our published new-carrier rate. Your actual advance rate, fees, approval, and funding time depend on our review of your business, verification of each load and invoice, your customers’ creditworthiness, complete paperwork, bank processing times, and other factors determined at FFS’s sole discretion, and may differ from any estimate shown on the Site.

3. Requesting a Quote Does Not Create a Binding Agreement

Submitting a form, requesting a quote, chatting with us, or speaking with a member of our team does not obligate FFS to purchase any invoice or provide any advance, and does not obligate you to accept any quote we provide. No factoring relationship becomes binding until you and FFS sign a separate, definitive written factoring agreement. That agreement, not this Site or these Terms, governs the actual terms of the relationship, including advance rates, fees, rush processing, recourse or non-recourse treatment, how your customers’ payments are handled, UCC‑1 filings, Notice of Assignment procedures, reserve release, and termination.

If any conflict exists between these Terms and a signed factoring agreement between you and FFS, the signed agreement controls with respect to the relationship it governs.

4. Information You Provide to Us

When you submit an application, request a quote, or otherwise provide information through the Site (including your name, company name, MC and DOT numbers, contact details, invoice volume, invoices, bills of lading, rate confirmations, and information about your brokers and shippers), you represent and warrant that:

  • The information is true, accurate, and complete;
  • You have the authority to submit it on behalf of the business you represent; and
  • You have any necessary authorization to permit FFS (or its funding partners) to verify the information you provide, including verifying loads and invoices with your brokers and shippers and reviewing their credit profiles.

Providing false or misleading information may result in denial of your request, termination of any resulting agreement, or other action available to us.

By submitting your phone number, email address, or other contact information through the Site, you consent to be contacted by FFS or its representatives by phone, text message, and/or email regarding your inquiry, using the contact information you provided, even if that number is registered on a do-not-call list. Message and data rates may apply to text communications. You may withdraw this consent at any time by notifying us using the contact information in Section 17 below. Our use of your information is further described in our Privacy Policy.

6. No Professional Advice

Nothing on the Site is intended as, and should not be relied upon as, financial, legal, tax, or accounting advice. You should consult your own advisors before making decisions about freight factoring, fuel advances, or any other financial arrangement.

7. Testimonials and Statistics

Testimonials and statistics referenced on the Site (including client statements, invoices purchased, years in business, and funding times) reflect the experiences of specific clients or aggregate historical data and are not guarantees of the results any particular carrier will achieve. Individual results vary based on your business’s specific circumstances, your customers’ creditworthiness, and market conditions.

8. Intellectual Property

All content on the Site, including text, graphics, logos, tools, calculators, and design elements, is owned by FFS or its licensors and is protected by applicable intellectual property laws. You may view and use the Site for its intended informational purpose, but may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

9. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose or in violation of these Terms; (b) submit false, fraudulent, or misleading information; (c) attempt to gain unauthorized access to any part of the Site, our systems, or related accounts; (d) interfere with or disrupt the Site’s operation, including through malware, scraping, or automated data collection not authorized by us; or (e) use the Site to submit invoices or information relating to any load or transaction you know to be fraudulent, fictitious, not yet delivered, or already factored, pledged, assigned, or encumbered to another party.

The Site may reference or link to third-party resources, tools, or services, such as our client login portal, our fuel card provider, and our live chat system. FFS does not control and is not responsible for the content, accuracy, or practices of any third-party site or service, and inclusion of a link does not imply endorsement.

11. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any estimate, calculation, or timeline displayed will match your actual results.

12. Limitation of Liability

To the fullest extent permitted by law, FFS and its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Site, reliance on any content or estimate provided on the Site, or these Terms, even if advised of the possibility of such damages. This limitation does not apply to obligations set out in a separate, signed factoring agreement between you and FFS, which will be governed by the terms of that agreement.

13. Indemnification

You agree to indemnify and hold harmless FFS and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your breach of these Terms, or information you submit that is false, fraudulent, or misleading.

14. Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you consent to personal jurisdiction in those courts. Before filing a formal claim, you agree to first contact us to attempt to resolve the matter informally.

15. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. Material changes affecting an existing signed factoring agreement will be governed by the amendment provisions of that agreement, not by this page.

16. Severability; Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FFS regarding use of the Site, and supersede any prior understandings regarding the Site (but not any separately signed factoring agreement, which is governed by its own terms).
